THIS RELEASE AND WAIVER is executed on DATE SIGNED ELECTRONICALLY ABOVE

In consideration of being permitted to occupy and access Releasee’s real property, Releaser, for himself or herself and his or her personal representatives, heirs, and next of kin, releases, waives, discharges and covenants not to sue ANDREW HALLINAN, WARRIOR MARKETING GROUP, LLC, CARRY DAILY and/or their officers and employees, personal representatives, heirs, and next of kin, and each of them, all referred to as Releasees, from all liability to the Releaser, his or her personal representatives, assigns, heirs and next of kin for all loss or damage, and any claim or damage therefor, on account of injury to the person or property or resulting in death of the Releaser, whether caused by the negligence of Releasee or otherwise while the Releaser is occupying or on the real property of Releasee for any purpose.

Releaser agrees to indemnify the Releasees and each of them from any loss, liability, damage or cost Releasees may incur due to the presence of Releaser in or on Releasee’s property whether caused by the negligence of the Releasees or otherwise. Releaser assumes full responsibility for and risk of bodily injury, death or property damage due to negligence of releases, other invitees, or otherwise while in or on Releasee’s property.

Releaser agrees that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of Florida and that if any portion of the agreement is held invalid, it is agreed that the balance shall notwithstanding, continue in full legal force and effect.

1. Risk Factors. I understand and acknowledge that the use of Releasee’s facilities involves risks including, but not limited to, the following: risk of property damage; bodily injury including, but not limited to, permanent disability, paralysis, and possibly death. These risks may result from a variety of circumstances including, but not limited to, the use or misuse of facilities, from the acts of myself or others, including the Releasee and its agents, or from the unavailability of emergency medical care.

 2. Assumption of Risk. I am using Releasee’s property of my own free will. I assume full responsibility for all risks that may arise out of or result from my use including, but not limited to, those risks described in Section 1 above.

3. Waive, Release, Indemnify, and Defend. I hereby waive, release, discharge, and hold harmless the Releasee, and all of their affiliates, predecessors, successors, trustees, officers, directors, faculty, employees, agent and representatives, past or present Releasees from any and all claims, suits, liabilities, judgment, costs and expenses (“Claims”) for any property damage, property loss or theft, personal injury or illness, death or other loss arising from or relating to my use of Releasee’s property. I also agree to defend, indemnify and hold harmless the Releasees from and against any claims arising from or related to my own acts or omissions in connection with my use of Releasee’s property.

 4. Waiver. I hereby waive any protections afforded by any statute or law in any jurisdiction whose purpose, substance and/or effect is to provide that a general release shall not extend to claims, material or otherwise, which the person giving the release does not know or suspect to exist at the time of executing the release. This means, in part, that I am releasing unknown future claims.

 5. Payment for Damages. I agree to pay for any and all damages to any property of Releasees caused by me negligently, willfully or otherwise.

 6. Jurisdiction. This Assumption of Risk, Waiver, and Release from Liability shall be governed in all respects by the laws of the State of Florida. The parties shall use the State of Florida for jurisdiction and Citrus County as venue for any disputes between the parties related to this Assumption or Risk, Waiver, and Release from Liability.

Releaser, being of lawful age, in consideration of being permitted to use Releasee’s property, does for himself or herself, his or her heirs, executors, administrators, and assigns, now release and forever discharge ANDREW HALLINAN, WARRIOR MARKETING GROUP, LLC, CARRY DAILY; and/or their heirs, administrators, and executors of and from any and every claim, demand, action or right of action, of whatsoever kind or nature, either in law or in equity arising from or by reason of any bodily injury or personal injuries known or unknown, death and/or property damage resulting or to result from any accident which may occur as a result of his or her use of Releasee’s property or any activities in connection with the same, whether by negligence or not.

Releaser further states that he or she has carefully read the above release and waiver and knows the contents of the release and waiver, and signs this release and waiver as his or her own free act. This Release shall remain in force and effect until cancelled in writing by Releaser by Certified Mail to Releasee at 10 Bahia Court Lane Ocala, FL 34472.

This release and waiver contains the entire agreement between the parties to this agreement and the terms of this release and waiver are contractual and not a mere recital. An electronic signature shall constitute an original signature.
